A wholly owned contract pharmacy is a pharmacy that is registered as a contract pharmacy on the HRSA OPAIS database and owned solely by the individual 340B covered entity or a health system that shares common ownership of the covered entity and the contract pharmacy.
The below outlines instructions on completing and submitting a wholly owned exemption application to the 340B ESP™ website.
From the 340B ESP home page, click Forms from the top menu bar then click Wholly Owned Exemption from the dropdown.
Click the manufacturer you would like to apply for an exemption.
*Not all manufacturers allow for wholly owned exemptions; only the manufacturers listed within the application on the platform allow exemptions. You will need to complete an application for each manufacturer
Enter your contact details including your work email address at your covered entity or authorized third party working on behalf of the covered entity.
Select the covered entity you are applying for—you may only apply for one covered entity per application.
Enter the wholesaler’s name(s) – you may add multiple wholesalers by clicking +Add Another Wholesaler.
Enter the wholly owned contract pharmacy details—you may add multiple pharmacies by clicking + Add Another Pharmacy.
Review the accuracy of the information provided in this section to ensure the timely processing of your application
Upload proof of ownership documents for verification, including Certificate of liability insurance or State business licenses- the ownership documents should align with the pharmacy address(es) listed in item 5.
Review the expiration date of the ownership documents prior to submitting—valid and complete documentation will ensure timely processing of your application
Complete the authorized person’s title, full name, and signature.
Confirm required steps are complete and submit the application by clicking Submit.
